Terms of Service
These Terms of Service (the “Terms”) govern your access to and use of Kyncept, including the website at kyncept.com and the tools for creating videos, images, music and 3D models offered there (the “Service”). By creating an account or using the Service you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility and accounts
You must be at least 18 years old, or the age of majority where you live if that is higher, to use the Service. You are responsible for your account, for keeping your sign-in credentials secure, and for all activity that happens under it. Tell us promptly at [email protected] if you believe your account has been used without your permission.
2. Acceptable Use & Content Policy
Our Acceptable Use & Content Policy is incorporated into these Terms by reference and forms part of them. Without limiting it, you may not use the Service to create, upload, request or share:
- sexual content of any kind, including pornography, sexual acts, fetish content and nudity;
- any content that sexualizes, or depicts in a sexual or suggestive context, anyone who is or appears to be under 18 — including fictional, animated or AI-generated depictions;
- non-consensual intimate imagery, including “undressing” or otherwise sexualizing a real person;
- deceptive deepfakes: content that places a real, identifiable person’s face, likeness or voice into material without their consent, or that is intended to deceive, defame, harass, impersonate or defraud;
- any other content that is illegal, or that infringes the intellectual property, privacy or other rights of anyone else.
You may not attempt to get around our safeguards — for example by rewording a refused request, splitting it across requests, or using uploaded images to introduce prohibited material.
3. Automated moderation and logging
Prompts, uploaded images and referenced images are screened by an automated content-safety system, uploaded images when they are received and every request before generation starts. Requests that appear to violate our policy are refused and not charged. We log refused requests and the screening result, and our team may review them, together with content created on your account, to enforce these Terms, to respond to reports, and to meet our legal obligations. We report child sexual abuse material to the relevant authorities.
4. Suspension and termination
We may suspend or permanently terminate your account, remove content, and refuse future service if you violate these Terms or the Content Policy, attempt to circumvent our safeguards, or use the Service in a way that creates legal risk for us or others. Termination for a violation is without refund of fees or unused credits, and we may report unlawful activity to law enforcement. You may stop using the Service and close your account at any time.
5. Your content
You keep whatever rights you have in the prompts and files you submit and in the results you create (“Your Content”). You grant us a worldwide, non-exclusive licence to host, process, store and display Your Content only as needed to operate, secure and improve the Service and to enforce these Terms. You confirm that you have all rights and consents needed for anything you upload — in particular, the consent of any identifiable person shown in it. AI-generated results may not be unique, and similar outputs may be generated for other users.
6. Subscriptions, credits and payments
Paid plans are billed in advance through our payment processor, Stripe, and renew automatically each billing period until cancelled. You can cancel at any time from your billing settings; cancellation takes effect at the end of the current period. Generations consume credits as shown in the Service; credits have no cash value and are not transferable. Requests refused by moderation are not charged. Except where required by law or stated otherwise on the pricing page, fees are non-refundable.
7. The Service
The Service relies on third-party AI models and infrastructure. We may add, change or remove models and features, and we do not guarantee that the Service will be uninterrupted or error-free, or that any output will meet your expectations. You are responsible for how you use the results.
8. Disclaimers and limitation of liability
The Service is provided “as is” and “as available”, without warranties of any kind to the fullest extent permitted by law. To the fullest extent permitted by law, Kyncept will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, data or goodwill, and our total liability for any claim relating to the Service is limited to the amount you paid us in the twelve months before the claim arose.
9. Indemnity
You agree to indemnify and hold Kyncept harmless from claims, losses and expenses (including reasonable legal fees) arising from Your Content or from your breach of these Terms or the Content Policy.
10. Changes to these Terms
We may update these Terms from time to time. We will post the updated version on this page and change the date above; for material changes we will give reasonable notice. Continuing to use the Service after a change takes effect means you accept the updated Terms.
